Affordable Housing Projects - Live Local Act

What is the Live Local Act?

The Live Local Act (SB 102 [2023]; amended by SB 328 [2024] and SB 1730 [2025]) requires local governments to allow multi-family and mixed-use residential projects in areas zoned for commercial, industrial, or mixed use, and in those portions of flexibly-zoned areas—such as Planned Developments (PDs)—permitted for commercial, industrial, or mixed use, if at least 40% of the units are affordable rental housing, as defined in § 420.0004, Florida Statutes, for at least 30 years.

Projects meeting the criteria:

  • Do not require rezoning, variances, or comprehensive plan amendments for height, density, or floor area ratio (FAR) allowed by the Act.
  • Must be administratively approved if they comply with all other applicable development standards and Comprehensive Plan provisions.

Before submitting a Live Local Act project for review, please ensure:

  • 1 The proposed project meets the eligibility criteria.
  • 2 The site is located in an eligible zoning district, and the project complies with the applicable multi-family residential (MFR) development regulations/performance standards for that district.
  • 3 All required documents are submitted to the Development Review Committee (DRC) Office, through which each Live Local Act project is processed. All Live Local Act projects must undergo review in accordance with the Process and Submittal Requirements established in the County's Live Local Act Standard Operating Procedures.
